Sexual Harassment, Rape & Sexual Assault
The University at Albany is committed to providing a campus where all of its members and guests feel comfortable and are free from the fear of all forms of exploitation, intimidation, and injury, including sexual harassment, rape and other forms of sexual assault. The University has been proactive in providing prevention education and in setting up response procedures for victims of sexual harassment and sexual assault. Coercive and violent behavior is not acceptable in this community and will be met with the strongest possible response. Sexual offenses as defined in the New York State Penal Code are subject to criminal prosecution. In addition, sexual harassment is a violation of Section 703 of Title VII of the Civil Rights Act of 1964. In Community Rights and Responsibilities, the University also explicitly defines and forbids sexual harassment, rape, and sexual assault (see page 2, Section IV, University Regulations #5 & #6).
The Office of the Vice President for Student Success (956-8140), the University Health Center (442-5229), the Affirmative Action Office (956-8110), the University Counseling Center and the Sexual Assault Resource Center (442-5800), the Department of Residential Life (442-5875) and the University Police Department (442-3131 or 911), provide protection, advice and support to victims of sexual harassment, sexual assault or rape. The University is aware of the critical importance of sexual assault victims having immediate access to crisis intervention services, health care services, a forensic rape kit exam to collect evidence, and criminal reporting. The offices just listed can offer students timely information, assistance and referral to an array of on-campus and off-campus resources (including 24 hour off-campus resources such as Albany County Rape Crisis (447-7716), the Sexual Assault Nurse Examiner Program at Albany Medical Center (262-3131), and local police agencies). Also, the Vice President for Student Success' Office can assist students in arranging academic and living accommodations and can provide referrals to judicial Success and to counseling services. Individuals who believe that they have been victims of these crimes are encouraged to file a complaint with the University Police Department, Affirmative Action Office, or the Office of Judicial Success. Perpetrators of rape, sexual assault or sexual harassment are subject to harsh sanctions from the University and/or the criminal justice system. The following sanctions may be enforced: disciplinary sanctions including expulsion, suspension or probation; financial restitution; termination of employment; criminal prosecution (felony or misdemeanor), and civil prosecution.
